Illegal use of human tissues or cells will be punished with jail

The illegal use of human tissues or cells by extracting them from living or dead persons by unauthorized persons or in unauthorized institutions will be punished with jail. A bill to this effect was passed by Parliament in the first reading, IPN reports.

The private individuals who will take such steps will be punished with 2 to 5 years in jail and banned from holding particular posts or performing particular activities for a period of 2 to 5 years. Legal entities will be fined 20,000 to 60,000 lei and will be banned from performing particular activities.

The illegal use of human organs or parts will be punished with 5 to 12 years’ imprisonment. The culprits will be banned from performing particular activities for a period of 2 to 5 years. Legal entities will be fined 60,000 to 100,000 lei and will be banned from performing particular activities.

Advertising for illegally obtaining human organs, tissues or cells or illegal donation will be penalized with a fine of 2,000 to 6,000 lei, while legal entities with a fine of 6,000 to 12,000 lei.

The MPs also adopted amendments to the Criminal Code article concerning trafficking in persons. Under them, the use of women as surrogate mothers is punished with 6 to 12 years in prison. The culprits will be banned from performing particular activities for a period of 2 to 5 years, while legal entities will be fined 60,000 to 100,000 lei and will be banned from performing particular activities, or will be liquidated.
