IDIS “Viitorul”: LPA reform is blocked as there are no clear laws

As there are no clear laws concerning the Local Public Administration (LPA), the LPA reform is blocked, says a study on the implementation of laws in Moldova carried out by the Institute for Development and Social Initiatives (IDIS) “Viitorul”, Info-Prim Neo reports. The study authors say that the conflict over the chairmanship of the Chisinau Municipal Council and many other disputes throughout Moldova were generated by the chaos in the legislation on the LPA. According to the IDIS expert Ion Beschieru, the local public administrations are often obliged by law to provide financial coverage for the projects or institutions that should be financed from the state budget and this has an impact on the small budgets of the settlements. The fact that the municipality of Chisinau is obliged, including by court decisions, to repay the debts for providing the prosecutors, judges and police with housing is a relevant example, Beschieru said. During the presentation of the study, the head of Nisporeni district, Ion Munteanu, said that the administration of the district is in litigation owing to legislative shortcoming, including concerning the number of deputy heads in a district. Asked if he agrees that the legislation on the LPA is deficient, the head of the Chisinau Administrative Control Division of the Ministry of Local Public Administration, Ghenadie Gluscenco said that the way in which the laws are implemented is a more serious problem. “In most of the cases, the laws are doubled,” the quoted source said. “At local level, every person interprets the law as they want, according to their interests,” he said. The study was presented on August 14.
