The Constitutional Court confirmed the fact that the provision of the Moldovan nationality by recognition by the Ministry of Information and Communication Technology does not run counter to the Constitution. The Liberal MPs earlier disagreed with this, asking the Court to pronounce on the issue, arguing that this is the duty of the head of state, IPN reports.
According to a press release of the Constitutional Court, the Nationality Law provides that besides naturalization and regaining, which are within the President’s areas of competence, the nationality of Moldova cam be gained by birth, recognition and adoption. The Court ruled that when granting nationality by recognition, the ICT Ministry just ascertains a fact based on justificatory documents, without having the power to provide nationality or not if all the legal conditions are met. Thus, it does not infringe on the relevant powers of the President of the Republic of Moldova.
The Constitutional Court’s decision is definitive and cannot be appealed and comes into force when it is published in the Official Gazette of the Republic of Moldova.
