The Court of Appeals on August 6 postponed the examination of the suit filed by the Mayor General of Chisinau Dorin Chirtoaca against the Chisinau Municipal Council (CMC), for the second time. Chirtoaca demands that the decisions regarding the work and dismissal of the CMC chairman Mihai Ghimpu and the appointment of Eduard Musuc as CMC president be canceled, Info-Prim Neo reports. The decision to postpone the hearing was taken by the court after Mihai Ghimpu challenged the validity of the power of attorney signed by the CMC secretary Valerii Didenco, by which the Council’s chairman Eduard Musuc was empowered to represent the defendant in court. Ghimpu said that under the Law on the Local Public Administration, the representative in court should be chosen by the Council and not by its secretary. Eduard Musuc considers that the power of attorney signed by Valerii Didenco is legal. At the CMC’s July 31 meeting, the secretary was empowered by the councilors on behalf of the PCRM, PPCD, PSD, PUM and by Valerii Climenco to decide who will represent CMC in court. Also then, the power of attorney in the name of the head of the Chisinau City Hall’s Legal Assistance Division Diana Gurschi was cancelled. The suit filed by the Mayor General was taken over by judge Domnica Manole after Mihai Ghimpu challenged the panel of judges at the previous hearing, accusing judge Elena Gligor of impartiality in another hearing on the same case. The next hearing will take place today, on August 7.
