The Superior Council of Magistrates admitted Gheorghe Balan's request to be reinstated as judge. The ruling will be forwarded to the president of the country in order to issue a decree.
During a meeting held on September 24, the interim president of the CSM, Dorel Musteață, specified that Gheorghe Balan was released from office last year due to a disciplinary offense. The Court of Appeal admitted the request for trial filed by the former magistrate, while the CSM ruling by which he was released from office was annulled. The Court of Appeal ascertained that the alleged disciplinary violation was not committed.
Gheorghe Balan’s disciplinary dossier was compiled last year on the basis of a notification of the Information and Security Service, following a complaint filed by the mayor and a group of councilors from the Puhăceni village, which is the judge's wife home settlement. They claimed that the magistrate allegedly participated in the meetings of the regional organization DA Platform.
Gheorghe Balan was noted in recent years for his harsh criticism of the judicial system. At the General Assembly of Judges held in March 2017, he gave a tough speech regarding the recent miscarriages of justice. Additionally, he was involved in the parliamentary elections of February 24, 2019, when he ran for Parliament in the uninominal constituency Anenii Noi, on behalf of the ACUM Bloc, yet lost the race.
Currently, he is acting chief of the General Inspectorate of Police, where he was appointed by the Minister of Internal Affairs, Andrei Nastase.
