Government sets cap for state tax charged on civil complaints
The Government on Thursday approved a modification to article 3 of the State Tax Law thereby setting an upper limit for the tax charged on civil complaints, Info-Prim Neo reports.
Currently the state charges a tax of 3 percent of the value of the damages, but no less than 150 lei ($12) from physical persons and 270 lei ($22) from legal entities. No upper limit is set.
Minister of Justice Alexandru Tanase told the Government's meeting on Thursday that the purpose of this tax is to compensate partially the expenses related to court activity and also to prevent actions taken in bad faith.
Since the upper limit of the tax is not fixed, the tax could be exaggeratedly large, which in many cases is an obstacle for people to seek remedy in court, argued the minister.
To ensure free and equal access to justice, the upper limit was set at 25,000 lei ($2,018) for physical persons and double for legal entities.
Parliament endorsement is still needed to enact the amendment.
