The Government has repealed several decisions regarding the concession process of the Chisinau International Airport, approved over the course of 2012-2013.
The repeal involves the public-private partnership concession project, the decision approving the concession of assets, the decision regarding the approval of the report on the conduction and the results of the closed competition for the concessionaire selection and the decision regarding the reconfirmation of the approval of the concession of assets.
“The decisions were approved contrary to procedures established by law. These decisions were approved by a resigning government. The Constitutional Court ruled the suspension of the government decisions no. 321 of May 30, 2013 and no. 715 of September 12, 2012, based on the provisions of art. 71 paragraph (2) letter. g) of the Constitutional Jurisdiction Code, i.e. the economic or financial security of the state”, explained the Minister of Justice, Olesea Stamate.
Prime Minister Maia Sandu said that the repeal of the government decisions are not retroactive, yet by this repeal the legal framework will be brought in line with the Constitutional Court ruling. After the September 4 government meeting, Maia Sandu said that "based on the information presented by the parliamentary committee and other state institutions, the Ministry of Justice is working on the case and will file it in court in the days to come, where the ministry will request the cancellation of the concession contract”.
The prime minister explained that the airport concession contract remains in force, until the court decides otherwise.
