The Cabinet considers that Article 68 of the Law on Civil Status Documents should be amended as it does not allow rectifying the nationality in children's birth certificates on the basis of the identification or civil status documents of the grandparents and other ancestors if parents' documents do not contain information about the nationality claimed by the applicant. MP Ana Gutu, who drafted the legislative initiative, believes this formula is restrictive and violates the right to ethnic and cultural self-identification, Info-Prim Neo reports. Ana Gutu suggests indicating the nationality in children's birth certificates on the basis of the birth certificates of the parents or grandparents, at the parent's request. Minister of Justice Alexandru Tanase said that though Article 68 must be modified, the solution proposed by Ana Gutu is not appropriate as the current procedure for writing and rectifying the nationality, about which the ECHR said it is incompatible with Article 8 of the European Convention on Human Rights in the case of Ciubotaru vs Moldova, will not be essentially changed. The bill does not clearly say what nationality is to be written in the child's birth certificate – of the child or of the parents, as the birth certificate does not include the “child's nationality” section. Moreover, the birth certificates of the grandparents issued before 1944-1945 do not contain information about the nationality, but only about religion. Thus, the bill does not guarantee the right to ethnic self-identification, the minister said. Alexandru Tanase also said that in most of the European democratic states, the identification and civil status documents do not contain information about the person's ethnicity and the Government is in favor of removing this section from the identification papers.
