Government does not give up anti-raider measures approved in August

The Cabinet returned to the anti-raider measures approved in August by taking responsibility before Parliament. The bill was repeatedly endorsed after the Constitutional Court declared the decision taken in summer unconstitutional. This time the bill is to be adopted by the lawmakers, Info-Prim Neo reports. The bill contains amendments to the Law on Financial Institutions, which is known as the Anti-Raider Law. Under the bill, a holding may be transferred to a bank’s capital with the exclusive preliminary written permission of the National Bank, based on definitive court decisions. In order to ensure the stability and safety of the banking system, the Government proposed asking for the central bank’s permission for dealings involving persons living in offshore countries or areas, regardless of the size of the holding transferred. The bailiffs will be obliged to give the sides 15 days for the voluntary implementation of the court decision. In such a case, there will be paid only a tax for starting and archiving the legal case and no other court decision implementation tariffs. The Disciplinary Board will be transferred from the National Union of Bailiffs to the Ministry of Justice. The Government said the move is aimed at ensuring greater responsibility and a swifter reaction to the violations committed by bailiffs. According to Prime Minister Vlad Filat, the legislative body should adopt the anti-raider measures by the end of the year.
