Government approves new draft law on governmental agent

The work of the Government’s representative at the European Court of Human Rights will be regulated by a new law that lays emphasis on the observance of the European Convention and its case law and on the strengthening of the national systems so as to reduce the number of applications filed to the ECHR. The bill was approved by the Government on April 8, IPN reports.

The draft law contains two new conceptions: of governmental supervision and of parliamentary control over the court decision implementation process. Between these two mechanisms, there will be an interdependent relation of responsibility between the authorities.

The bill suggests that the governmental agent should further work under the Ministry of Justice, which is a broadly used practice in many Council of Europe member states. To ensure the independence and authority of this institution, the method of naming the governmental agent by a Government decision was kept. The bill was drafted in a move to carry out the measures stipulated in the plan of action for implementing the justice sector reform strategy for 2011-2016.
