Government agrees to advocacy reform
The executive approved the bill on the modification of a number of normative documents concerning advocacy formulated by the Ministry of Justice, Info-Prim Neo, quoting sources in the Ministry.
The bill provides for the modification of the institution of advocacy by creating an organizational institution consisting of five regional bar associations, laying down strict criteria for entering the profession, acting as representative in court, etc. The status of the lawyer on probation was specified. The disciplinary punishment mechanisms and the norms concerning the continuous training of lawyers were modified. There were formulated a number of amendments to the Civil Code and the Code of Administrative Offenses.
The bill aims to strengthen the institution of advocacy by reviewing Law No. 1260-XV on advocacy and other normative documents (the Civil Code, the Code of Administrative Offenses) so as to change the perception of the role of the lawyer. It was drafted in accordance with the recommendations of the Committee of Ministers of the Council of Europe and of the Council of Europe formulated in their expert reports on the law on advocacy.
The Ministry of Justice says the latest press reports concerning the amendments planned by it to the law on advocacy are groundless and are aimed at misinforming the people about the advocacy reform.
The Ministry formulated amendments to the law on advocacy in concert with a working group composed of representatives of the Bar Association of Moldova, the National Council for State- Guaranteed Legal Aid, the Bar Association ”Public Lawyers”, the Law Program of Soros – Moldova Foundation and the Norwegian Mission of Experts for the Supremacy of Law in Moldova (NORLAM) after analyzing the normative framework and identifying the problematic areas that affect advocacy.
