The General Assembly of Judges is to convene on October 20, 2017. The assembly will choose five standing members of the Superior Council of Magistracy from among judges and two substitute members and the standing members of the Council’s Disciplinary Board from among judges and five substitute members. A decision to this effect was taken in the August 8 meeting of the Superior Council of Magistracy, IPN reports.
On October 18, the terms in office of two Council members – Dumitru Visternicean and Anatolie Turcan – expire. The term of Nina Cernat expires in November, of the Council’s chairman Victor Micu next January, while of Vera Toma next March. Of the current composition, Dorel Musteata will continue to serve on the Council as he was elected by the General Assembly of Judges in October 2014.
The Superior Council of Magistracy consists of judges and law professors. The president of the Supreme Court of Justice, minister of justice and prosecutor general are ex-officio members. Six members from among judges, including two substitute members, are chosen on the Council by the General Assembly of Judges, by secret vote. These represent all the levels of courts of law.
Another three members of the Council are chosen by Parliament from among law professors by a majority of votes, at the suggestion of at least 20 MPs, taking into account the opinion of representatives of the parliamentary opposition. In this regard, the legislature is to name three candidates who will replace Gheorghe Avornic, Violeta Cojocaru and Teodor Carnat, who were all appointed by Parliament in December 2013.
Also, the extraordinary meeting of the General Assembly of Judges will choose members of the Disciplinary Board of the Superior Council of Magistracy from among judges, instead of Valeriu Doaga, Stelian Teleuca, Anatolie Galben, Elena Kovalenko and Domnica Manole.
The General Assembly of Judges will be held at the Holiday House situated at 1 Ghioceilor St.
