GenderDoc-M warns it will sue media outlets that allow hate speeches

The information and documentation center GenderDoc-M has said that it does not intend to limit the right to expression, but will sue the media outlets that do not moderate the hate speeches and insults, Info-Prim Neo reports. The statement was made in reaction to the conviction of the website privesc.eu, which was sued by journalist and human rights activist Oleg Brega. “On February 9, the website privesc.eu broadcast live videos from a news conference organized by GenderDoc-M. There was an online chat on the site, where the visitors could exchange replies, statements and opinions. Oleg Brega took part in the conversations, providing explanations about homosexuality and the human rights. Afterward, he was insulted and threatened, but the site owners did not filter the used words,” coordinator of the “Lobby and Advocacy” program of the Gender Doc-M Center Angela Frolov said in a news conference. Human rights expert Doina Ioana Straisteanu, lawyer for the plaintiff in the case of Brega versus Privesc.eu, formulated a series of recommendations for the Moldovan media outlets. “The newspapers, radio stations, TV channels and the website must not allow hate speeches in their broadcast area. These institutions must possess data about those who comment on the information, the IP addresses of those who do it anonymously or the electronic addresses,” said Doina Ioana Straisteanu. The lawyer said it is very important that those who receive a preliminary application from a plaintiff take it serious and do not try to avoid responsibility. In the same news conference, Oleg Brega said that he asked the moderator of the chat to remove the comments that incited to hatred. “The moderator not only allowed the insulting remarks, erasing only the links written by me, but incited those who made comments, saying I should be exiled on an islands together with all those who form part of the LGBT community,” said Oleg Brega. After this case, Oleg Brega addressed an application to the founders of the site privesc.eu, but received an extensive answer, saying they are not responsible for the chat comments. He thus sued the site and the first court ruled in his favor, ordering that the site owners pay damages of 5,200 lei to him and the state taxes. The decision can be appealed to a higher court. Oleg Brega said this website is not the only one that was sued and they intend to sue a platform of blogs that allow hate speeches and insults.
