Functionaries to blame for Moldova’s conviction by ECHR to be sued

The public servants blamed for human rights violations confirmed by the conviction of Moldova by the European Court of Human Rights (ECHR) will be sued by the Ministry of Justice, Minister Vladimir Cebotari told a news conference on January 27, quoted by IPN.

Vladimir Cebotari said the Ministry will file such lawsuits on each case lost by Moldova at the ECHR. Today, there will be sued 37 functionaries and judges who include judges of district courts of law and Appeals Courts and employees of the prosecution service. The list will be published on the Ministry’s website.

According to the minister, these persons will be sued in the name of Moldova and will have to cover the costs incurred by Moldova after it was convicted by the ECHR. The Ministry of Justice will also determine what possessions those to blame have so as to ensure the damage is repaired. The mentioned cases refer to domestic violence, non-protection of personal data, illegal detention, violation of the right to a fair trial, etc.

“The Ministry of Justice for the first time will file civil lawsuits against persons holding executive posts in courts of law and the local and central public administration, who, by their action or inaction, contributed to the violation of the human rights,” stated Vladimir Cebotari.

The minister noted that there are no precedents for such a situation and they will now act attentively so as to set precedents. Such measures will be taken every time Moldova will be convicted by the ECHR.
