The public contests organized by the Superior Council of Magistracy (SCM) are mimicked and the judicial system is obedient to the political class. The Council works closely with the politicians and the judges most of the times obey the governments, said former SCM member Teo Cârnaț.
“The power in the state is common and is divided into the judicial power, legislative power and executive power. If a branch is weak, like the judicial power, it is looking for protection in the legislative power, like Parliament, or in the executive. In the Republic of Moldova, the judicial power often looks for a master,” Teo Cârnaț stated in the talk show “Expertise Hour” on Jurnal TV channel.
Former minister of justice Olesea Stamate said that the governments in time exerted pressure on the system and this was weakened instead of being strengthened.
“The judicial system in the Republic of Moldova is as it is. It represents the mirror of our society and inside the judiciary we have a number of honest and courageous people, while all the others, who form the majority, regrettably do not understand that the role of the judge in this state is extremely important. This separation of powers is very important for ensuring a balance and control over the functionality of institutions. It is not only their blame as, during the existence of the Republic of Moldova as an independent state, almost each government tried to bring this system under control. They exerted pressure on judges through different methods, which were sometimes harsher and sometimes more drastic. The judiciary, instead of strengthening itself, became weaker. The people from the system didn’t become more courageous, if only some of them,” stated Olesea Stamate.
The two former justice system functionaries stated their opinions in connection with the contest to choose the SCM president that will be held on July 28 and 29. Besides, there will be decided the winners of the contests to fill the posts of president and vice president of the Supreme Court of Justice, the Chisinau Appeals Court, the Bălți Appeals Court and other national courts.
