Former RED Nord director: “A debt cannot be paid twice”
Gheorghe Pelin, the former director of the power distribution network SA RED Nord, says the Ukrainian company Energoalians' claim for the debt of US$1.5 million is groundless, Info-Prim Neo reports.
In a news conference on June 11, Gheorghe Pelin said Energoalians indeed supplied power to RED Nord, but not directly but through the intermediary firm Feren-M, to which RED Nord in 2000 paid 20 million lei (about US$1.5 million). The money was to be transfigured to Energoalians, but the intermediary firm did not fulfill its obligations. Pelin said a debt cannot be paid two times.
In 2005, Energoalians sued RED Nord over the debt, but the Economic Court of Appeals rejected its application. In two years, Energoalians lodged a complaint with the Supreme Court of Justice of Moldova, asking it to review the decision of 2007.
“The president of the Supreme Court of Justice Ion Muruianu accepted the application and declared RED Nord insolvent. Those who say they defend the interests of the state do everything possible to make RED Nord pay a debt twice,” Pelin said.
“The present administration of RED Nord is also to blame. The director general Igor Savin and the head of the law division Iosiv Mardari, instead of asking the Ministry of Economy, which is the major shareholder of SA RED Nord, to appeal the decision of the Court of Appeal, asked that the debt be rescheduled. This means that a nonexistent debt was accepted.”
The Chisinau Court of Appeals declared SA RED Nord insolvent. A temporary administrator was named at the company so that the executive team is limited in its activities.
