First Moldovan judge dismissed for passing illegal sentence

A judge of the Hancesti Court was discharged from post by the Supreme Council of Magistrates after he ‘tried’ a case without being present at the hearing two years ago. The Council took such a decision following the irrevocable judgment passed by the Supreme Court of Justice, which condemned the judge for pronouncing a sentence against the law, IPN reports.

The prosecutors established that the culprit signed proceedings of a hearing of May 20, 2012, which de facto didn’t take place as the judge was then at the Supreme Council of Magistrates. The document contained false information about the presence of the trial participants, including the judge and the offender, the hour of the hearing and the statements of the sides. At the request of the prosecutor general, the judge was suspended from post.

On July 12, 2013, the Buiucani Court found the judge guilty and fined him 8,000 lei, banning him from holding posts in he judicial system and the law enforcement bodies for a period of five years. The prosecutors also accused him of abuse of power, but the Court acquitted him on this count.

The appeals to the Chisinau Appeals Court and the Penal Board of the Supreme Council of Magistrates were rejected, while the decision of the Buiucani Court was upheld.

Based on the irrevocable conviction decisions, the Supreme Council of Magistrates on November 25 decided to dismiss the judge.
