Filat’s defense files two appeals to Supreme Court of Justice

The lawyers for ex-Premier Vlad Filat lodged two apples with the Supreme Court of Justice by which they ask to annul the decisions of November 9, 2016 to reject the request to raise the exceptions of unconstitutionality from three articles of the Penal Procedure Code. Lawyer Igor Popa asked to notify the Constitutional Court (CC)so that it pronounced on the three articles, IPN reports.

The three articles of the Penal Procedure Code say that no person can be forced to make statements contrary to their interests or the interests of relatives or close persons, that the court’s conclusions about the other issues are included in the hearing proceedings and that the chair of the hearing can limit the public’s access to the hearing, taking into account the conditions in which the case is tried.

The lawyers for the former Prime Minister Vlad Filat consider the request to notify the Constitutional Court was rejected by the judges abusively, illegally and groundlessly. “The judges of the Chisinau Appeals Court abused their power as they pronounced on the constitutionality of norms invoked by lawyers instead of the constitutional judges. But the examination of the constitutionality of the challenged norms is exclusively within the competence of the CC,” the lawyers says in a posting.
