Family claims they are ejected from own apartment

Marcelina Bordeinyi and her father Simion Tabacaru are forced to leave the apartment where they have lived for almost 30 years by a bailiff. In a news conference at IPN, the woman said the bailiff gave them one hour to vacate the apartment.

The apartment is owned by the municipality of Chisinau. In 2008, there was issued an order to give the apartment to other persons. Following trials in all the courts of law, the Supreme Court of Justice decided that the woman and her father should be ejected.

“We have lived in this apartment since 1986. We do not have debts and pay all the taxes. My father is a pensioner, but works now at the Choral Chapel “Doina”. They want to force us out. In the morning, my father was taken to the hospital by an ambulance,” Marcelina Bordeinyi told the journalists.

The jurist of “Solutia” Foundation Victor Poleacov, who offers legal advice to the family, said that officials of the Chisinau City Hall assured the two that they will not be ejected until all the circumstances are examined.

Victor Poleacov said that only the Chisinau Municipal Council can issue orders to distribute apartments. But it is illegal to issue such an order for an apartment that is inhabited. “There are many such cases in the municipality of Chisinau. There is a man with locomotor disabilities who is also to leave his apartment,” he stated.

After the conference, the woman and the jurist were to have a meeting with the head of Buiucani district to discuss the issue.
