Former judge Lilia Vasilevici seeks 240,000 lei damages from ex-prosecutor of Chisinau municipality Ivan Diacov in a slander case. Ivan Diacov said the case was registered with violations and the court should have refused to try this as the period during which this could be started expired.
In a news conference at IPN, Ivan Diacov said the statements for which he was sued and which Lilia Vasilevici classed as defamatory were made in news conferences in 2013-2014. Procedurally, the judge could have sued him during 20 days, but she did it in a year.
The ex-prosecutor said the damages claimed by Lilia Vasilevici were calculated taking into account the salary revenues that the judge failed to get after she was dismissed by the decision of the Superior Council of Magistracy. “Wait a little. Did I dismiss her from post? It was the SCM that discharged her. She challenged the decision at the Supreme Court of Justice and went through all the courts. Everyone ruled that she was correctly dismissed,” said Ivan Diacov.
The ex-prosecutor criticized the activity of the ex-judge, saying this passed judgments that were annulled after they were disputed in upper courts. Moldova, owing to Lilia Vasilevici, lost a number of cases at the European Court of Human Rights, stated Ivan Diacov, who considers that the judge was promoted to post based on political criteria and in her activity fulfilled political orders.
Ivan Diacov suspects that someone wants Lilia Vasilevici to return to the system and the case in which he is accused of slander forms part of the same scenario. “In a normal state, where justice works in the interests of the citizens, a criminal case over her actions would have been started long ago,” he said.
The judgment in the case that involves Ivan Diacov is to be passed on March 6.
