Ex-director Vasile Chirică and employees of SRL “Glorinal” have been prosecuted for the same deed for two times, in breach of the law, said lawyer Valeriu Pleșca. According to him, the repeated indictment of 2020 (for the same deed as in 2017) was aimed rather at justifying the arrest of decision makers of the company. The lawyer said Vasile Chirică on January 15, 2021 requested prosecutor general Alexandr Stoianoglo to replace prosecutor of the Prosecutor’s Office for Organized Crime and Special Cases Sergiu Petrușca and to transmit the case to another prosecutor.
“He argued that prosecutor Sergiu Petrușca, contrary to the provisions of the Penal Procedure Code, is not independent in fulfilling his duties in the trial, does not obey the law only and is directly interested in the trial. He related that prosecutor Sergiu Petrușca is suspected of being involved in illegalities committed earlier. He made reference to public information according to which prosecutor Sergiu Petrușca, on January 30, 2019, issued 20 ordinances to wiretap telephone conversations of representatives of the opposition, civic activists, journalists investigated in criminal cases started by order,” lawyer Valeriu Pleșca stated in a news conference at IPN.
He related that criminal proceedings again decision makers of SRL “Glorinal” were instituted on June 2, 2017, for appropriation of another person’s property by swindle. On September 3, 2020, another criminal case was started over the same deeds indicated in the ordinance of June 2, 2017. They both refer to the signing of investment contracts by SRL “Glorinal”, through the agency of the manager and employees of this company, with investors for building homes, commercial areas and parking places in the residential complex situated on Calea Orheiului St in Chisinau, and to the receiving of money based on these contracts. But this time Vasile Chirică and the employees of “Glorinal” were accused of abuse of power.
Vasile Chirică was charged with the commission of an offense by an organized criminal group involving own employees of SRL “Glorinal”, whose duties were stipulated in individual work contracts and other internal documents of the company. On September 8, 2020, prosecutor Sergiu Petrușca indicted Vasile Chirică, asking the same day the Ciocana branch of the Chisinau City Court to place him under arrest. Remand detention for 30 days was ordered on September 9, 2020 and this was later replaced with house arrest that was extended until December 17, 2020, also at the request of Sergiu Petrușca. After being held at Penitentiary No. 13 in inhuman and degrading conditions, Vasile Chirică’s state of health worsened and on December 26, 2020 he was admitted to the Emergency Medicine Institute.
Valeriu Pleșca said they are waiting to see if the Prosecutor’s Office announces the sending of the case against the “criminal group” to court and what happens to SRL “Glorinal” in the insolvency procedure and with its assets.
