A raider attack is being staged on the Capital Constructions Division as particular persons aim to obtain the enterprise’s property. The municipal enterprise is not insolvent, said the head of the Chisinau Accounting and Economic Analysis Division Eugenia Ciumac. She has told IPN that 3.5 million lei will be allocated to the company SC “Fastcomtrans” SRL from the local budget and the court will have to declare the enterprise solvent.
Eugenia Ciumac said that by this court decision, particular persons aim to appropriate the enterprise’s assets without knowing that these assets are actually public property and cannot be sold, sequestrated or sold without the consent of the Chisinau Municipal Council.
The Division’s head also said that the court passed an incorrect judgment when it recognized the municipality’s debt of 3.5 million lei to SC “Fastcomtrans” SRL as there was no document confirming the completion of the repair works at the Chisinau-based Theoretical Lyceum “Mihail Kotsiubinski”.
Contacted by IPN in the morning of May 3, the head of the Legal Assistance Division of the Chisinau City Hall Diana Gurschi said that she does not possess information about the Chisinau Appeals Court’s judgment and that she found out about it from the press.
“We didn’t see such documents. We examined the extract from the Cadaster Agency. There is no ban and no decision in this regard. No relevant documents reached the Chisinau City Hall. For such to be valid, they must be registered with the Cadaster Agency first,” stated Diana Gurschi, noting that representatives of the municipality weren’t summoned to court in such a case and there is no such case registered with the Division.
She also said that there was a conflict between SC “Fastcomtrans” SRL and the municipal enterprise. In 2006, the company claimed 11 million lei from the municipality for repairing two nurseries based on contracts. This asked for the money in the absence of documents showing the completion of works and the court ordered that the company should be paid 3.5 million lei.
“Afterward, we asked the National Anticorruption Center to examine the contracts. The expert analysis showed that the signatures awere false. Based on this conclusion, an application to review the case was submitted to the Supreme Court of Justice so that the sum of 3.5 million lei was also annulled. It is strange to accept to sequester the property of a public enterprise or insolvency proceedings against it when there is a document from the National Anticorruption Center showing that the signatures were false,” stated Diana Gurschi.
Recently, the Chisinau Appeals Court sequestrated the assets of the Capital Constructions Division of the Chisinau City Hall and appointed a temporary administrator to this body, which is one of the richest one from patrimonial viewpoint. This risks becoming insolvent. The court took this and other decisions after examining the introductive application submitted by representatives of the creditor SC “Fastcomtrans” SRL concerning the institution of insolvency proceedings against the debtor IM “Directia Constructii Capitale” (“Capital Constructions Division”) of the Chisinau City Hall. The given measures are aimed at preventing the modification of the state of the debtor’s property.
