Economic courts to be reorganized to commerce courts

The economic courts will be preserved, in conformity with the recent decision of the Constitutional Court, but will be renamed to commerce courts and will have a limited jurisdiction. The bill providing these changes has been developed in an urgent manner by the Ministry of Justice and approved today by the Government, Info-Prim Neo reports. Justice Minister Oleg Efrim said the district commerce courts will have jurisdiction to hear appeals against arbitration awards, to issue writs of enforcement and to hear cases concerning the reorganization of juridical persons. Other economic cases will be transferred to courts of general jurisdiction and the appeals will be heard by the Chisinau Court of Appeals. The bill also proposes the liquidation of the Economic Court of Appeals. The judges working at this court will be reassigned according to the recommendations formulated earlier by the Superior Council of Magistracy. The cases pending before the district economic courts and the Economic Court of Appeals should be transferred to the relevant courts within 15 days from the publication of the law. The bill also provides the reorganization of the panels within the Supreme Court of Justice and reviews their jurisdiction. Prime Minister Vlad Filat noted that the bill doesn't contradict the decision of the Constitutional Court. He stated that the judicial reform needs to be further continued, so that courts “administer justice instead of defending narrow group interests”. The bill is to be submitted to Parliament very soon.
