ECHR passes judgment in case of Moldovan woman banned from seeing her child

Moldova was for the first time found guilty of violating the right to family and private life that is enshrined in the European Convention of Human Rights. The decision of the European Court of Human Rights (ECHR) in the case of Iulia Tocarenco, who is not allowed to see her minor child, was communicated by lawyers Violeta Gashitsoi and Roman Zadoinov in a news conference, IPN reports.

Violeta Gashitsoi said that Iulia Tocarenco was banned from seeing her five-month-old child by her former husband and parents-in-law. The law enforcement bodies did nothing to help the mother see her child and didn’t punish her former husband and parents-in-law. The ECHR rejected the Government’s arguments that the father and the child could not be found and ordered that the mother and minor child should be reunited.

“The state must immediately take measures to restore the relations between the mother and child. The ECHR said the case will be supervised by the Committee of Ministers of the Council of Europe so that the court decision is implemented,” said Roman Zadoinov.

The ECHR awarded €9,500 damages to the plaintiff. According to Zadoinov, this money will be paid from the state budget for the mistakes and incompetence of the judges, prosecutors and police officers. Moreover, if the plaintiff’s rights are further violated, she can go repeatedly to the European Court and can obtain Moldova’s conviction against.

Iulia Tocarenco said in the news conference that she has been through a terrible ordeal and does not know where her child is. Her ex-husband does not answer the phone and does not open the door when she goes to his place to see her child.
