Representatives of the employers association “Condominium Co-owners Associations” calls on the dwellers of blocks to organize themselves and form condominium owners associations given that the condominium law that provides that the four existing management forms – Privatized Dwelling Owners Associations, Homebuilding Cooperatives, Condominium Co-owners Associations and Housing Sector Managing Enterprises – will disappear was adopted last November. These say that many of the housing sector managers do not know about the new provisions or intentionally do not launch the reorganization process, aiming to maintain the defective forms of management.
In a news conference at IPN, Irina Melnic, a member of the association, said the Republic of Moldova is the only country with four forms of management of the housing sector. The law passed in November provides that these will be reorganized into Condominium Owners Associations. “The goal of the given law is to ensure the functioning and appropriate maintaining of the blocks and to defend the legitimate interests of all the owners through the signing of individual contracts between the owner and the association. Another goal was to set a block maintenance share,” stated Irina Melnic.
Association member Timofei Durleșteanu said that to set up a Condominium Owners Association, the dwellers of a block should form an initiative group that would convoke the General Assembly of Dwellers. As a result, there will be drawn up proceedings that will contain the vote for the constitution, the selection of the Administration Board, etc. The condominium constitution document will be submitted for registration to the local cadastral body and to the state registration body of the Public Services Agency.
The Association’s executive director Ianuș Cușnir said the law will take effect in half a year of the publication in the Official Gazette, but the time limits for reorganizing the management forms vary for each organization apart. The reorganization process is expected to start in the middle of this year. If the time limits are not respected, the state will become involved in the process and the Condominium Owners Association will be constituted automatically. The set of documents will be transmitted to the local public authorities and the mayor’s office, by contest, will choose a professional manager for the blocks that didn’t meet the reorganization deadlines. According to members of the Condominium Co-owners Association, a foreign person cannot efficiently manage a building where this does not live. The people should be broadly informed about the new legal provisions, including by placing such information on the opposite side of bills.

The representative of the employers association Nicoleta Popa said the association starting with 2016 has provided legal and logistic support and consultancy for defending the rights and interests of its members, namely Condominium Co-owners Associations, Privatized Dwelling Owners Associations and Homebuilding Cooperatives.
