Dorin Chirtoaca and Alexandru Tanase win case at ECHR
The Grand Chamber of the European Court of Human Rights (ECHR) decided in favor of Mayor of Chisinau Dorin Chirtoaca and Minister of Justice Alexandru Tanase, former councilor of Chisinau, in a case against Moldova. The applicants challenged the law that bans the persons with dual nationality from holding public posts, Info-Prim Neo reports, quoting a communique from the City Hall.
In 2008, the ECHR accepted the application filed by Chirtoaca and Tanase against Moldova, ruling that the persons occupying public positions can hold dual nationality. Then, the Government of Moldova refused to abrogate the law and asked the Grand Chamber of the ECHR to reexamine its decision.
The Parliament of Moldova adopted the law concerning the dual nationality of public persons on December 7, 2007. On April 29, 2008, the head of state promulgated the law.
Presently, the persons with dual nationality are allowed to hold public posts.
