The decisions of the Municipal Council of Chisinau on the reorganisation and announcement of an investment contest for selling municipal stations “Antena C” and “Euro TV Chisinau” could be suspended. This was announced by 3 municipal councillors – Mihai Roscovan, Ion Mamaliga and Oleg Cernei, who forwarded an interpellation to the Chisinau Administrative Control Department within the Ministry of Local Public Administration, requesting that the legality of the respective decisions be verified. The interpellation says that the mentioned decisions have no legal support; they are abusive and have the aim to liquidate unfoundedly, via illegal procedures, the respective municipal enterprises. On the other hand, councillors assert that the legislation allows the alienation of public property only following a strictly established procedure. These procedures have not been followed when adopting the decision on December 14. Moreover, those who announced the investment contest, ignored the fact that such tenders can only be announced in the case of “public property, included in the Privatisation Programme”, and that the tender committee has to include representatives of the Government Cabinet. According to the councillors, by this decisions CMC exceeded its functions, first of all by instituting the tender committee formed only by the representatives of the City Hall; second, by announcing the illegal selling of the patrimony which is not included in the Privatisation Programme and the dismissal of the two managers of the stations, which has been operated at the proposal of a councillor, a fact which contravenes the legislation. The interpellation included a range of serious violations of the procedure of adopting the two decisions. 4 projects have been proposed in the session of November 30, but neither of them had the positive advisory opinion of the specialised committee. At the same time, the reorganisation commission has been organised without respecting the legal procedures. In the session of December 14 a decision draft has been voted, which contained several violations, and didn’t receive the approval of the committees. Mihai Roscovan stated that the list of violations continued with the publishing of the announcement on the organisation of the contest. The commission was to work out the mechanism for organising the contest, but 2 members of the respective commission haven’t even been invited to its sittings. In the opinion of Oleg Cernei, the decisions made on November 30 and December 14 by CMC will be suspended. According to him, investors should not risk and participate in the contest till a final decision is approved. Moreover, the councillor says that this contest is a “farce”. The 3 councillors told a press conference that during several discussions, both the interim mayor Vasile Ursu, and the leader of the communist faction in CMC recognised that the respective decisions have been made at someone’s command.
