Decision to declare state of emergency challenged in CC

MP Octavian Țîcu requested the Constitutional Court (CC) to declare unconstitutional the Government decision of March 30 to propose declaring a state of emergency and the Parliament decision of March 31 to declare a state of emergency. According to the MP, the two decisions are not constitutional because the state of emergency can be proposed only by the President or the plenipotentiary Government, but not by the current outgoing Cabinet that has limited powers, IPN reports.

The MP told a news conference that the current executive could not propose declaring a state of emergency. Moreover, the next day three MPs of the Party of Socialists put forward that bill to declare a state of emergency, which is illegal as the principle of separation of powers in the state was violated.

“It is not within the remit of Suhodolski, Bolea (Socialist MPs, e.n.) or others to come up with initiatives when this is not stipulated in the Constitution. I say it again – this is a Moldovan political stratagem to use the cover of constitutionality depending on the interests they have,” stated Octavian Țîcu

According to him, the Government’s proposal to declare a state of emergency does no stipulate any urgent measure that should be taken by the executive or the Commissions for Exceptional Situations and this is against the Constitution.

On March 31, Parliament declared a state of emergency for a period of two months. The decision was taken by the votes of 52 Socialist MPs and MPs of the For Moldova platform that includes the MPs of the Shor Party. The opposition MPs criticized the executive for not presenting a concrete action plan for overcoming the crisis, saying this is actually a plan for delaying the snap parliamentary elections.
