Cristina Țărnă: The establishment of the prosecutor general pre-selection commission is unconstitutional

Former deputy director of the National Anticorruption Center, Cristina Țărnă, said that the establishment of the commission that selects and puts forward at least two candidates for the position of prosecutor general to the Superior Council of Prosecutors is unconstitutional, because it is not provided for in the supreme law. The statement was made at the TV8 show "Cutia neagră".

According to her, the CSP does not support the government's ideas, the president of the country has less representation in the government, that is why an extra-CSP commission is created, which aims to limit the CSP's discretion in conducting this contest. "The entire point of the clause in the Constitution that provides that the CSP elects the prosecutor general is to allow the prosecutors to self-govern. They included the eligibility criteria of professionalism, integrity and entrusted these tasks to the CSP. It should have been left alone to do its task. By creating this commission, which is not provided for by the Constitution and in which the prosecutor isn't really a prosecutor, we, de facto, take away the self-governing prerogative", said Cristina Țărnă. In her opinion, this commission, de facto, replaces the CSP.

Former Secretary of State at the Ministry of Justice, Nicolae Eşanu, said that neither the Superior Council of Prosecutors nor the Superior Council of Magistracy are bodies that should govern the system. "The interest of society is above. Yes, there are bodies that take decisions in these fields, however, they do not self-govern the system", said Nicolae Esanu. The former secretary of state is of the opinion that out of the current claimants who have submitted their applications, the are persons who can be elected as prosecutor general.

The Ministry of Justice announced that it has received 20 candidacy dossiers for the prosecutor general competition. The candidates are: Anatolie Istrate, Ilie Rotaru, Alexandr Stoianoglo, Maxim Gropa, Veaceslav Soltan, Eduard Bulat, Ruslan Cașu, Ruslan Popov, Alexandru Rața, Vsevolod Ivanov, Serghei Perju, Tudor Andronic, Ion Vicol, Artur Lupașco, Vladimir Adam, Gheorghe Malic, Vladislav Gribincea, Ștefan Gligor, Oleg Crîșmaru and Octavian Bodareu.
