Criminal cases will be examined in absence of person if this avoids investigation bodies

The Ministry of Justice will submitted to the Government a bill that enables examining criminal cases in the absence of the person if this avoids the actions taken by the law eonforcement agencies. The bill was presented by Minister of Justice Litvinenco in a news conference, IPN reports.

“You know that we have many cases when persons who are suspected of causing damage to the state and of stealing money of citizens managed to flee the country or to hide. For these reasons, the criminal cases cannot be completed and the persons cannot be held accountable. To remedy the situation, we suggest a number of solutions for charging a person who is outside the country,” stated the minister.

If the person avoids prosecution and flees to another country, but the prosecutor knows the person’s place of stay, this can ask the authorities of the given state to formulate the indictment. Later, the case could be sent to court.

Another mechanism for charging the person in the absence of this refers to the situation when this person went missing and the whereabouts are not known. “In such a case, the accusations will be formulated in the absence of the accused and the investigation will be completed by a judge of inquiry at the request of the prosecutor who will order completing the investigation in the absence of the accused, presenting the copy of the indictment order with the signatory of the elected lawyer or of the one who provides state guaranteed legal aid,” said the minister.

After the conviction sentences are passed by court, if the court orders to confiscate property of the convicts, this could be done.
