CpDOM will sue authorities for holding minor in psychiatric hospital

The Moldova Center for Human Rights (CpDOM) will file a lawsuit against the authorities over irresponsibility and indifference in the name of a minor child who was illegally held in a psychiatric hospital, IPN reports.

Head of the CpDOM Child Rights Protection Service Tatiana Crestenco found out about this case when she visited the psychiatric hospital. The orphan was held there for four months at a time when the treatment period prescribed by the doctor was 21 days. After the period of 21 days expired, the hospital’s director announced the responsible authorities that the minor is to be discharged. Only the administration of the boarding school where the child studied earlier reacted, informing that they cannot accept the minor back because he was at their school for a fixed period of time, in accordance with an order made by the Ministry of Education.

The representative of the Nisporeni Social Assistance and Family Protection Division and the mayor of Nisporeni didn’t react. Only after the CpDOM functionary discussed with them, the child was taken from the hospital and placed in the family of relatives for a month. The tutelage authority is preparing the documents needed to place the child in a residential institution even if measures are taken at national level to deinstitutionalize the children and place them in alternative services.

In a communiqué, CpDOM says that at the age of five, the minor witnessed the murder of his mother and didn’t benefit then from rehabilitating psychological assistance. Afterward, he had been under the tutelage of relatives, which in 2012 refused to take care of him further and the minor in 2013 and 2014 stayed at two placement centers, two boarding schools and the psychiatric hospital.

Tatiana Crestenco established that the representatives of the public authorities of Nisporeni and of the village from which the minor is do not honor their obligations and do not obey the national and international legal norms. The CpDOM informed the Government’s secretary general about this case, asking identifying the faults in the management of the public affairs concerning the procedures for instituting/annulling guardianship, and intends to notify the Prosecutor’s Office of it so that this case is examined from criminal viewpoint too.
