Court of Appeals Chisinau rules in favour of Termocom again
The Court of Appeals Chisinau decided in favour of Termocom SA and upheld the decision obliging the Chisinau Municipal Council to pay 149 million lei to the heat supplier, Info-Prim Neo reports, making reference to a communiqué from Termocom. The judgement was delivered on February 12.
According to the cited source, by the given decision the Council’s appeal was rejected, classed as groundless and unsupported and the decision of the District Economic Court of December 14, 2007 was upheld.
The District Economic Court ruled in favour of Termocom SA in the dispute with the Chisinau City Hall and CMC and obliged the two to pay the debt of 149 million lei to the heat supplier. The debt represents the difference in the heating charge of 540 lei and the price of 233 lei paid by the population that the City Hall pledged to cover.
On December 4, 2007, the City Council cancelled the tariff of 540 lei. At end-January, the court cancelled the given decision. On February 4, Termocom SA appealed to the Court of Appeals Chisinau asking it to oblige CMC to approve an administrative document for adjusting the price of the heat supplied by Termocom SA to all the categories of consumers.
On December 20, 2007 CMC transferred 48.2 million lei to Termocom SA for covering the hot water consumption of the population in April-November 2007. It was the last time that the municipal authorities allocated money to the heat supplier.
