Court of Appeal rejects the request on suspending the decision of CMC on the reorganisation of “Antena C” and “Euro TV Chisinau”
The Chisinau Court of Appeal rejected on Tuesday, January 9, the request of the employees at “Antena C” and “Euro TV Chisinau” to suspend the decision of the Chisinau Municipal Council (CMC) and the disposals of the interim mayor on the reorganisation of the 2 institutions. The claimants are decided to dispute de decision in the superior court.
Judge Mihai Ciugurean, who examined the case, qualified the request as unjustified, referring to the Civil Procedure Code and ordered the withdrawal of the request with the right to appeal to the Supreme Justice Court within 20 days.
One of the claimants, Ecaterina Stratan, the vice director of “Antena C” told reporters that “taking into consideration the experience of other cases that were examined in Moldova, such a decision was expected, but the claimants hoped that the court suspended the decisions of the CMC, so that the reorganisation process would be democratic and transparent and the employees would have the possibility to work in compliance to the laws”.
According to Maria Orlov, the lawyer of the claimants, the court did not take into consideration that the issue is related to the Administrative Disputed Claims Code that says that the defendant is a public authority, and not an individual. The lawyer says that all the decisions of the court that do not comply with the law will be appealed.
38 employees working at the two stations requested to urgently suspend the procedure of selling the two institutions and annul the precursory normative documents; to cancel interim mayor’s orders regarding the appointment of new managers of the TV channel and radio station; to oblige CMC and interim mayor to re-establish the proper functioning conditions of the institutions; to oblige CMC and interim mayor to pay damages amounting to MLD 100 thousand for each claimant.
