Court enforcement officer suspended for alleged serious violations
Court enforcement officer George Botan was suspended from duty by order of Justice Minister Oleg Efrim after being accused of serious violations of law, the Ministry of Justice said in a press release.
The suspension comes after a debtor alleged in a complaint that on August 21the officer initiated an enforcement procedure without notifying him of his rights and obligations. According to the complainant, the enforcement officer violated a number of rules when conducting the procedure, in particular he failed to list, describe and estimate all the assets being seized. Further, the officer is accused of seizing an amount of cash without counting it and writing down the face value of the bills. As a result, the debtor complained that the cash disappeared.
Further, according to the complainant, instead of accepting a bank transfer for the return of the seized assets, the officer requested cash which he allegedly intended to use for personal purposes.
The Ministry noted that this is not the first complaint against the court enforcement officer. His case has been submitted to the Disciplinary Council of the Court Enforcement Officers to decide on a disciplinary sanction.
