Court decision enforcement process will be optimized, justice minister says

The creditor will be obliged to provide money for drawing up the enforcement documents within the term set by the legal enforcer and will demand that these expenses are later covered by the debtor. If there are several creditors, the sum needed to calculate the enforcement-related expenses will be provided by one of them or by all the creditors proportionally to the debt, Info- Prim Neo reports. Minister of Justice Vitalie Parlog said that the amendments introduced by the executive to the Enforcement Code aim to optimize the court decision enforcement process and to reduce the number of non-implemented decisions. “Owing to the lack of financial resources for drawing up the enforcement documents, there are a lot of cases when the decisions are implemented with delay or are not implemented. If the creditor is obliged to cover the enforcement-related costs and the debtor is made to pay them later, the state of affairs will change and the economic entities and other creditors will not have to wait for months to obtain the money owed to them,” the minister said. Vitalie Parlog said that the legislation of such countries as Germany, France, Estonia and Latvia stipulates expressly that the creditor is the person that covers in advance the expenses for preparing the enforcement documents and, in the end, presents the documents confirming the given expenses, which are to be paid by the debtor, to the enforcement body or court. Taking into account the fact that the state taxes make up over 50% of the value of the enforcement documents, the zonal fiscal inspectorates and other bodies that carry out forced enforcement procedures will be allocated resources that will be used to cover the expenses on behalf of the state if need be in order to insure the appropriate enforcement.
