Council of Europe dissatisfied with excessive length of judicial proceedings and non-compliance with ECHR decisions in some countries
The Council’s of Europe Committee of Ministers worked out a series of resolutions by means of which it draws up the attention of several countries, especially Italy and Turkey over the non-compliance with the judicial decisions of the ECHR and excessive length of judicial proceedings in respondent states.
According to a press release from the Council of Europe, cited by Info-Prim Neo, the Committee of Ministers urged Italian key authorities to hold to their political commitment to solving the problem of the excessive length of judicial proceedings. This structural problem in the Italian judicial system has led to thousands of violations of the European Convention on Human Rights. Also, the Committee encouraged the Italian authorities rapidly to take all further measures needed to eliminate the practice of "indirect expropriation" of land by the public authorities.
On the other hand, the Committee of Ministers stressed that Turkey should comply with the judicial decisions because it renders the right to a court illusory and leads to situations incompatible with the rule of law. In the case of the Turk authorities it was brought the example of a decision which was not executed for more than 6 years.
Moldova was also repeatedly accused of delaying proceedings and non-compliance with the decisions of the ECHR and on Tuesday, February 13 it was condemned for the 50th time by the Court.
