Contradictory opinions concerning reformation of prosecution service

The strategy for reforming the prosecution service of Moldova became the subject of heated debates in the talk show “Politics” on TV 7 channel, IPN reports.

Ion Dron, head of the Association “Justice and Fairness”, considers that this reform is aimed at enabling a group of at most four persons to take control of this institution. “I will be happy if this strategy is rejected. The Prosecutor’s Office will only lose a part of its independence. What is the reason? What will the Prosecutor’s Office gain if the prosecutor general is named by the head of state, not by Parliament? It would be better if the prosecutor is voted in by Parliament already,” he said.

Lawyer Pavel Midrigan said the reform of the prosecution service is necessary. “Such veterans of the prosecution service as Dumitru Postovan and Ion Diacov consider such a reform is not needed. The problem resides in the system. The current strategy and the laws that refer to the prosecution service are good. The way the laws are respected in our country is yet another subject,” he stated.

One of the authors of the strategy, director of the Legal Resources Center Vladislav Gribincea said this reform is designed to improve the activity of the prosecutor’s office. “The powers of prosecutors are to be reviewed. These will no longer carry out inspections when they want. The penal process will remain their main task. The method of choosing the prosecutor general will offer greater independence to the prosecution service. Under the bill, only the persons with seniority of at least five years as prosecutor and 10 years in juridical posts can become prosecutor general. I think we will introduce a democratic European system with this reform,” he stated.

Viorel Morari, head of the Prosecutors Qualification Board, welcomed the bill, saying it will have a positive impact. “We witness lack of professionalism among prosecutors and corruption in the system. As a result of this reform, the prosecutors will enjoy more independence and will not depend on the senior prosecutors. The prosecutors will be subject to integrity tests and will be even tested on the polygraph,” he stated.
