Constitutional Court’s decision is formal and illegal, PLDM

The Liberal Democratic Party (PLDM) considers that the decision by which the Constitutional Court validated Wednesday the April 5 parliamentary elections is formal and illegal, Info-Prim Neo reports. The PLDM first vice president Alexandru Tanase told a news conference on Thursday that the decision was illegal because the Constitutional Court ignored three contestations filed by three political parties that claimed electoral violations that challenge the election outcome. On the same day, the PLDM appealed the decisions of the Central Election Commission (CEC) to the Chisinau Court of Appeals. “The Constitutional Court pronounced on none of the accusations and validated formally the results of the elections. We think that this is an illegality. The Court was obliged to suspend the examination of the election results until the Chisinau Court of Appeals, as competent judicial authority, passed judgment on the PLDM’s contestation,” Tanase explained. He said yet that such a decision was predictable. “It did not surprise us because the Constitutional Court in Moldova is not an independent entity,” Alexandru Tanase said. The PLDM is convinced that this year’s elections have been rigged, while the results announced by the CEC and validated by the Constitutional Court do not correspond to the electorate’s choice. “The power installed by the Court’s decision yesterday is not representative because this result was achieved by gross manipulations during and before the election campaign. The provocation of the destruction of state buildings by representatives of the power and secret services formed part of the same scenario and aimed to discredit not only the Opposition, but also those that have another viewpoint on the present and future of this country” the PLDM first vice president said. On April 22, the Constitutional Court validated the legislative elections that took place in Moldova on April 5, 2009. Though the Opposition parties presented documents showing that 20,000 irregularities were committed during the elections, the Court ignored them, saying they were submitted too late. The Opposition said they would vote for no candidate for the post of President of Moldova. In this case, early elections could be held in Moldova. The representative of the Communist Party Sergiu Sarbu told the reporters that the PCRM would find the only vote they need to elect the head of state. According to the final election results, the PCRM will hold 50 seats in the new Parliament, the PLDM and PL – by 15, while the AMN – 11.
