Constitutional Court will examine Premier’s challenge Thursday

The Constitutional Court on October 21 will examine Prime Minister Vlad Filat’s challenge, whereby he asks ruling on the constitutionality of suspending the ministers from posts for the period of the election campaign, Info-Prim Neo reports. Vlad Filat said earlier that if all the parties withdraw their ministers, the Cabinet will not be able to take decisions as the quorum will not be present. Under Article 13 of the Election Code, the members of the Cabinet and civil servants must quit their positions for the period of the election campaign after they are registered as election contenders. According to the Premier, this is against the constitutional norms, which define the principle of continuity of the Cabinet’s mandate. The right to elect and be elected is a fundamental one and any arbitrary limitation of this right is inadmissible, Vlad Filat says in the challenge that he submitted to the Constitutional Court on October 12. The quorum in the Cabinet is 12. The AMN has four ministers, while the PDM and PLDM – by three. The PL withdrew its ministers from the lists of candidates. Under the legislation, the Premier is not obliged to quit his post.
