Constitutional Court warns about shortcomings in electoral legislation

The Constitutional Court will caution Parliament that the electoral legislation does not clearly regulate the restrictions and responsibilities of the election contenders, which leads to inequality of chances, Info-Prim Neo reports. Constitutional Court judge Valeria Sterbet stated that Article 13 of the Election Code says any public servant running in elections must leave their jobs for the period of the election campaign. But this stipulation does not solve the problem of the use of administrative resources, according to the judge. There is no clear regulation that would say how a public person can be prevented from using administrative resources. The statements were made following the judgment passed by the Constitutional Court on the Government’s application to examine the constitutionality of Article 13 that obliges the ministers to quit their posts for the period of the election campaign. The Court ruled that the article is in accordance with the Constitution, with one judge having a different opinion.
