Constitutional Court to examine constitutionality of suspending ministers
The Constitutional Court is examining today the constitutionality of Article 13 of the Election Code, which obliges the members of the Cabinet to quit their posts for the period of the election campaign if they are on the lists of candidates for elections, Info-Prim Neo reports.
The application was submitted by the Government as the Court on October 21 suspended the examination of a similar submission made by Prime Minister Vlad Filat. The Court argued that the Premier is not entitled to lodge such applications in his name and a Government Decision was needed.
The Government considers that Article 13 of the Election Code is unconstitutional as it runs counter to Article 103 of the Constitution, which says the Cabinet’s mandate ends when a new executive is constituted. But now there is no quorum in the Cabinet because most of the members had to leave their posts as they run as candidates in elections.
