Constitutional Court returns challenge over Election Code to Liberal MPs
The Constitutional Court Thursday sent back the challenge filed by Liberal MPs Oleg Bodrug, Boris Vieru and Corina Fusu so that it is brought in compliance with the Code of Constitutional Jurisdiction. The authors of the application consider that the Election Code provisions concerning the justification of the domicile or residence confirmed by stamped document and the issuing of voting certificates must be declared unconstitutional, Info-Prim Neo reports.
Contacted by Info-Prim Neo, Dumitru Tara, the head of the Court’s press service, said that while preliminarily examining the challenge the Court established that it contains a number of inaccuracies. It does not contain arguments proving the unconstitutionality of the disputed provisions and the constitutional norms to which they are in contradiction, as required by the Code of Constitutional Jurisdiction.
The Court suggested removing the mentioned drawbacks and specifying the demands. It also recommended taking into account the impact of the Court’s decision on the electoral procedures now that the election campaign is at its height, and the recommendations of the Code of Good Practice in Electoral Matters adopted by the Venice Commission in October 2002.
Earlier, the Constitutional Court ruled that the phrases ‘domicile visa’ and ‘residence visa’ are unconstitutional.
