Constitutional Court rejects request to overturn Stoianoglo decree

The Constitutional Court upheld its November 16 decision to reject the request to overturn the presidential decree of 26 September that removed Alexandr Stoianoglo from the post of Prosecutor General.

The request was lodged by a group of Communist MPs.

On November 16, the Court’s acting president Liuba Șova found that the request did not meet the standards of the Law on the Constitutional Court and the Code of Constitutional Jurisdiction.

Today’s Constitutional Court decision is irreversible and unappealable.

Constitutional judges Serghei Țurcan and Vladimir Țurcan formulated dissenting opinions.

In May 2022, the Superior Council of Prosecutors proposed to President Maia Sandu to sack Alexandr Stoianoglo after a commission found him to have done a poor job as Prosecutor General. The president signed the decree in September of this year. Meanwhile, Alexandr Stoianoglo scored a legal victory at the European Court of Human Rights in one of his two complaints. In particular, the ECHR found that there had been a violation of Stoianoglo’s right to a fair trial, in that he was unable to challenge the Superior Council’s decision that led to his suspension from office.

On November 9, the Constitutional Court declared unconstitutional the article based on which Alexandr Stoianoglo was evaluated.
