The Constitutional Court dismissed as inadmissible the complaint by which MPs affiliated to Ilan Shor requested to check the omission by the President of the Republic of Moldova to issue the decree on the confirmation of the governor of the autonomous territorial unit of Gagauzia as a member of the Cabinet, IPN reports.
The complaint was filed in February by MPs Marina Tauber, Reghina Apostolova, Denis Ulanov and Vadim Fotescu. The authors state that, by the judgment of May 22, 2023, the Comrat Court of Appeals confirmed the legality of the elections of the governor of Gagauzia of May 14, 2023 and validated the term of Evgenia Guțul, who took the oath of office and took up her duties on July 19, 2023. At the same time, the Law on the Special Legal Status of Gagauzia (Gagauz-Yeri) stipulates that the Governor of Gagauzia is confirmed as a member of the Cabinet of the Republic of Moldova by a decree issued by the President of the Republic of Moldova.
The authors of the complaint note that, although several months have passed since Mrs. Evgenia Guțul took office as governor of Gagauzia, President Maia Sandu has not issued a decree on her confirmation as a member of the Cabinet.
According to the authors of the complaint, the omission to issue the given decree runs counter to the provisions of the Constitution and of the Law on the Special Legal Status of Gagauzia.
The Constitutional Court found that the object of the complaint does not fall within the scope of constitutional jurisdiction. The interpretation and application of the legal provisions, in the present case of the failure to issue the presidential decree, is within the remit of administrative courts.
For these reasons, the Court rejected the complaint as inadmissible. This decision is final, cannot be appealed, enters into force on the date of adoption and is published in the Official Gazette.
