Constitutional Court refuses to validate seat of MP of BCS substitute

The Constitutional Court did not validate the seat of MP of Svetlana Popa - a substitute candidate on the lists of the Bloc of Communists and Socialists (BCS). The Court rejected the Central Election Commission’s request in this regard. At the same meeting, the Court validated the seat of MP of Ion Poia - a substitute candidate on the lists of the Party of Action and Solidarity (PAS), IPN reports.

As for Svetlana Popa, she was reportedly penalized by a court as a councilor on the Chisinau Municipal Council following a vote for the Zonal Urban Plans. The court also decided to deprive her of the right to hold the position of councilor on the CMC.

At the meeting, Svetlana Popa said that it was a collective vote of the entire group after which 33 councilors were sued. The charges against 32 local councilors were dropped, not yet against her. Although she appealed the decision, she failed to appear at the hearing. As a result, the decision of the first court was upheld and the judgment became irrevocable. In his opinion, this decision is not an impediment to the validation of her seat of MP, as it is expressly stipulated that the ban refers only the position of councilor on the CMC. 

The two seats of MP remained vacant after Gheorghe Agheorghiesei of the PAS and Adrian Lebedinschi of the BCS tendered their resignations.
