Constitutional Court accepts AEI’s application on election of President

The Constitutional Court accepted the Alliance for European Integration’s request to interpret Article 78 of the Constitution, which describes the procedure for electing the head of state, Info-Prim Neo reports, quoting a communiqué from the Court. The application can be examined within six months of the day it is submitted. The application signed by MPs Mihai Ghimpu, Tudor Deliu, and Raisa Apolschi was filed on April 6. The authors argue that there are no legal and constitutional provisions that would ban the repeated dissolution of the legislative body as a result of the non-election of the head of state and would oblige the legislature to apply a sustainable procedure for electing the President. Liberal lawmaker Victor Popa has told Info-Prim Neo that the application was lodged with the aim of unblocking the procedure for electing the head of state. “The Constitutional Court can take a decision whereby to allow the Parliament to amend the procedure for electing the President by an organic law,” he stated. According to the communiqué, the Constitutional Court asked the Venice Commission to pronounce on the matter, but no answer came yet. The legal deadline of two months, within which a decision on the application was to be taken, expired on June 6.
