Compulsoriness of wearing mask in open public places challenged in court

The decision by which the municipal Extraordinary Public Health Commission made mask wearing in open public places in Chisinau mandatory was challenged in court by a law firm. According to lawyer Iulian Rusanovschi, the decision is illegal, while the imposed measure is unconstitutional, IPN reports.

“First of all, by this measure the constitutional rights to free movement and to private life are seriously violated. These rights can be limited only by laws adopted by Parliament, under the judgment passed by the Constitutional Court on June 23, 2020. Also, the decision is not aimed at containing the COVID-19 pandemic as it stipulates that the people can wear any kind of mask and what is important is for them to have something on the mouth,” stated Iulian Rusanovschi.

According to him, those who want to fight this virus should strengthen the immunity of the risk group - persons older than 50 - by covering the cost of drugs containing vitamins and zinc and by other similar methods. “You cannot fight a virus by dispersed, barbarous and Bolshevik methods. In such countries as Bulgaria, Denmark, Sweden and the Netherlands, where mask wearing is not mandatory in closed places, the infection rate is much lower than in the Republic of Moldova,” noted the lawyer.

The Extraordinary Public Health Commission of Chisinau municipality on November 20 decided that the wearing of protective masks in all the open public places all over the municipality of Chisinau, for all the categories of persons, is mandatory. Also, the protection measure to cover the nose and mouth remains valid for closed public places, including in public transport. The mask must cover the nose and mouth.
