Competition watchdog takes on ACC and GSA

Chisinau's water and sewer utility “Apa-Canal Chisinau” (ACC) will have to stop billing customers for technical losses and installation of water meters, and the bus stations' operating company “Garile si Statiile Auto” (GSA) will have to stop asking passengers for unjustified fees, under a decision of the National Agency for Competition Protection. The decision came after an assessment of prices on the request of Deputy Speaker Vlad Plahotniuc. The prices were checked for correspondence with the Law on Competition Protection, in particular Art. 6 and 7, which forbid price fixing agreements and abuse of the dominant position on the market. “ACC as a company with a dominant position on the market violates the law, and the obtained profit is unlawful. Taking money for the difference in the readings of the apartment meters and the common meters is an unlawful practice”, the Agency said in a press release, adding that ACC is also obliged to install water meters free of charge, as provided in the 2003 Consumer Protection Law. The Agency also found that GSA was demanding a number of unlawful fees from its customers, including a 5 lei entrance fee for each private car, a 10 lei fee for car parking, and fees for booking. As a result of the Agency's order, the tickets are expected to become by 3% cheaper. Also, GSA will have to give up the unlawful profit.
