CNA remains under Government’s management

The Constitutional Court (CC) will not pronounce on the constitutionality of the decision to transfer the National Anticorruption Center (CNA) under the management of the Government, as unaffiliated MP Sergiu Sarbu asked in an application on May 16, IPN reports.

The judges decided that it is not within the competence of the Constitutional Court to state its opinion on the issue as the legislative body has the exclusive right to adopt provisions concerning the pubic authorities and their powers and to decide how they should be implemented.

As the supreme law stipulates nothing about the CNA, its creation and work are within the Parliament’s remit. The Court’s decision is definitive and cannot be appealed.

The CNA was transferred under the Government’s management by a decision passed by Parliament on May 3.
