Chisinau Court of Appeals refuses to examine AMN’s and PL’s applications over MP seat distribution

The Chisinau Court of Appeals on Wednesday announced that it is not within its competence to examine the contestations filed by the Moldova Noastra Alliance (AMN) and the Liberal Party (PL) over the distribution of the seats of MP by the Central Election Commission (CEC). The representatives of the two parties to the CEC say that the judge did not clearly explain his decision, avoiding bearing responsibility. “If the Supreme Court of Justice also rejects our contestation, we will appeal to the Constitutional Court (CC),” said Nicolae Raileanu, the AMN’s representative to the CEC. The CC’s spokesman Dumitru Tara has told Info-Prim Neo that if the contestations reach the Constitutional Court, they will be attached to the case concerning the validation of the July 29 parliamentary elections. The PL and AMN do not agree with the way in which the CEC distributed the MP seats. According to their calculations, done according to another formula than that used by the Commission, the PCRM should hold 74 seats in the future legislature, the PLDM – 17, the PL – 16, the PDM – 13, while the AMN – 8. This means that the PCRM and the PLDM should have by one seat less, while the PL and AMN by one seat more. According to the official results, the PCRM will hold 48 seats, the PLDM – 18, the PL – 15, the PDM – 13, while the AMN – 7. The Constitutional Court is to declare the July 29 early legislative election valid or invalid within 10 days.
